CONCERNING
AMENDMENT TO THE REGULATION OF THE MINISTER OF FINANCE No. 163/PMK.04/2007 CONCERNING EXEMPTION OF IMPORT DUTY ON THE IMPORTED GOODS BY CENTRAL GOVERNMENT OR REGIONAL GOVERNMENT FOR PUBLIC INTEREST

THE MINISTER OF FINANCE,

Considering:

a. that based on Regulation of the Minister of Finance concerning Amendment to the Regulation of the Minister of Finance No. 163/PMK.04/2007 concerning Exemption of Import Duty on the Imported Goods by Central Government or Regional Government for Public Interest, on the Imported Goods by Central Government or Regional Government for public interest will be granted exemption of import duty;

b. that in the framework fast and simple service process of imported goods by Central Government or Regional Government for public interest, it is necessary to change mechanism to grant exemption of import duty on the imported goods by Central Government or Regional Government for public interest;

c. that based on consideration as intended in paragraph a and paragraph b, it is necessary to stipulate Regulation of the Minister of Finance concerning Amendment to the Regulation of the Minister of Finance No. 163/PMK.04/2007 concerning Exemption of Import Duty on the Imported Goods by Central Government or Regional Government for Public Interest;

In view of:

1. Law No. 10/1995 concerning Customs (Statute Book No. 75/1995, Supplement to Statute Book No. 3612) as amended by Law No. 17/2006 concerning The Amendment to Law No. 10/1995 concerning Customs (Statute Book No. 93/2006, Supplement to Statute Book No. 4661);

2. Presidential Decree No. 56/P/2010;

3. Regulation of the Minister of Finance No. 163/PMK.04/2007 concerning Exemption of Import Duty on the Imported Goods by Central Government or Regional Government for Public Interest;

HAS DECIDED:

To stipulate:

REGULATION OF THE MINISTER OF FINANCE CONCERNING AMENDMENT TO THE REGULATION OF THE MINISTER OF FINANCE No. 163/PMK.04/2007 CONCERNING EXEMPTION OF IMPORT DUTY ON THE IMPORTED GOODS BY CENTRAL GOVERNMENT OR REGIONAL GOVERNMENT FOR PUBLIC INTEREST

Chapter I

Several provisions in Regulation of the Minister of Finance No. 163/PMK.04/2007 concerning Exemption of Import Duty on the Imported Goods by Central Government or Regional Government for Public Interest shall be amended as follows:

1. Provision in Article 4 paragraph (1) shall be amended, so Article 4 is read as follow:

"Article 4

(1) To obtain exemption of import duty on the imported as intended in Article 2, Central Government, Regional Government, or third party as intended in Article 2 paragraph (2) shall file application to the Minister of Finance with attention to Director General of Customs and Excise.

(2) Application as intended in paragraph (1) enclosed by:

2. Provision of Article 5 paragraph (1) is amended, so Article 5 is read as follows:

"Article 5

(1) Director General of Customs and Excise on behalf of the Minister of Finance shall approve or reject the application of exemption of import duty as intended in Article 4 paragraph (1).

(2) In case application of exemption of import duty as intended in paragraph (1) is approved, the Director General of Customs and Excise on behalf of the Minister of Finance shall issue decision of exemption of import duty.

(3) Decision of exemption of import duty as intended in paragraph (2) shall have detail, sum, kind and customs value estimation of goods are given exemption of import duty, and decide unloading port.

(4) In case application of exemption of import duty as intended in paragraph (1) is rejected, the Director General of Customs and Excise on behalf of the Minister of Finance shall issue rejection letter and state the reasons of rejection."

Article II

1. By this Ministerial Regulation comes into force, applications of imported goods by Central Government or Regional Government for public interest are being processed, will be processed based on this Ministerial Regulation.

2. This Ministerial Regulation shall come into force on the stipulation date.

For public cognizance, this Ministerial Regulation shall be promulgated by placing it in the State Gazette of the Republic of Indonesia.
